Terms of Service

Site Administration — LLP "QazGene", authorized employees managing the website, acting on behalf of the Service Provider.

Website — the internet resource located at https://genelab.kz, including all its subdomains, sections, and pages.

Services — a set of services provided through the Website, including: - Decoding genetic test results using AI; - Consultations with geneticists; - Access to personal account; - Information materials about SMA (Spinal Muscular Atrophy); - Genetic risk calculator; - AI chatbot for consultations.

User (Customer) — a natural person who has reached the age of 18, or a minor aged 14 to 18 with the consent of legal representatives, using the Website and Services.

Service Provider — LLP "QazGene", providing Services through the Website.

Geneticist — a medical specialist with a current license providing consultations through the GeneLab.kz platform.

Offer Agreement — a public offer from the Service Provider, addressed to an indefinite circle of persons, to conclude an agreement on the terms set forth in this document.

Acceptance of the Offer — full and unconditional acceptance of the terms of this Agreement by registering on the Website and/or using the Services.

2.1. This document is an official public offer from the Service Provider and defines the terms of use of the Website and provision of Services.

2.2. The Agreement is concluded by accepting this offer. Acceptance is considered to be:

• Registration on the Website;
• Use of any Website Services;
• Uploading medical documents;
• Payment for services (if paid services are available).

2.3. The Agreement is governed by the legislation of the Republic of Kazakhstan, in particular:

• Civil Code of the Republic of Kazakhstan;
• Law of the Republic of Kazakhstan "On Consumer Rights Protection";
• Code of the Republic of Kazakhstan "On People's Health and Healthcare System";
• Law of the Republic of Kazakhstan "On Personal Data and their Protection".

2.4. The Site Administration reserves the right to change the terms of this Agreement at any time unilaterally without prior notice to the User. The new version comes into force from the moment of its publication on the Website.

2.5. Continued use of the Website after making changes means the User's agreement with the new terms.

3.1. The Service Provider undertakes to provide the User with access to the Website Services, and the User undertakes to use the Services in accordance with these Terms.

3.2. Website Services include:

• Information services: providing information about SMA, genetic testing, interpretation of results;
• AI test decoding: automated analysis of genetic test results using artificial intelligence;
• Specialist consultations: providing access to geneticist consultations;
• Genetic calculator: a tool for calculating the probability of having a child with SMA;
• Personal account: personalized space for storing medical data and consultation history;
• AI chatbot: automated answers to questions about SMA and genetic testing.

3.3. The Service Provider provides technical capability to use the Services but does not guarantee medical accuracy of AI analysis results. Final interpretation of results is performed by a geneticist.

3.4. Services may be free or paid. Payment terms are indicated on the relevant Website pages.

4.1. The User is obliged to:

• Provide accurate, current, and complete information during registration;
• Keep information up to date;
• Independently ensure confidentiality of credentials (login, password);
• Immediately notify the Administration of any unauthorized access to the account;
• Not use Services for illegal purposes;
• Not upload malicious software;
• Not violate third-party rights;
• Comply with the legislation of the Republic of Kazakhstan;
• Understand that AI analysis results are preliminary and require confirmation by a doctor.

4.2. The User has the right to:

• Access all free Services after registration;
• Require confidentiality of provided medical data;
• Delete their account and personal data at any time;
• Receive technical support regarding Website use;
• Appeal actions of the Service Provider in accordance with the legislation of the Republic of Kazakhstan.

5.1. The Service Provider is obliged to:

• Ensure Website operability and Service availability;
• Protect User personal data in accordance with the Privacy Policy;
• Provide technical support;
• Ensure involvement of qualified geneticists with current licenses;
• Inform Users about changes in Terms of Use.

5.2. The Service Provider has the right to:

• Change Website and Services functionality;
• Temporarily suspend Website operation for technical maintenance;
• Block or delete User accounts if these Terms are violated;
• Refuse to provide Services without explanation;
• Use anonymized data for statistics and Service improvement.

6.1. AI analysis of genetic test results is an auxiliary tool and cannot be considered as a final medical diagnosis.

6.2. Final interpretation of test results and diagnosis is carried out exclusively by a geneticist.

6.3. Geneticist consultations on the platform do not replace in-person visits to a specialist.

6.4. The Service Provider is not responsible for:

• Decisions made by the User based on information obtained through the Website;
• Inaccuracies in AI analysis results;
• Quality of medical services provided by geneticists (physicians are personally responsible);
• Errors in medical documents uploaded by the User.

6.5. The User is solely responsible for the accuracy of uploaded medical documents.

7.1. The Service Provider is not responsible for:

• Technical failures caused by third-party actions or force majeure circumstances;
• Website unavailability for reasons beyond the Service Provider's control;
• User actions based on information obtained through the Website;
• Disclosure of personal data as a result of account hacking due to User's fault;
• Losses arising from the use or inability to use the Services.

7.2. The User is responsible for:

• Accuracy of information provided;
• Security of their credentials;
• Any actions performed under their account;
• Violation of third-party rights when using Services.

7.3. In case of User violation of these Terms, the Service Provider has the right to block access to the Website without prior notice and without refund.

8.1. Some Services are provided free of charge, others may be paid. The cost of paid Services is indicated on the relevant Website pages.

8.2. Payment is made online through payment systems integrated on the Website.

8.3. After payment, the User receives access to the paid Service according to its description.

8.4. Refunds are possible in the following cases:

• Technical failure preventing the provision of paid Service;
• User's refusal of service before its provision begins (within 24 hours of payment);
• Double payment by mistake.

8.5. Refund is made within 10 business days to the account from which the payment was made.

8.6. Refund is not made if the User has already used the paid Service (received consultation, test decoding, etc.).

9.1. All Website materials (texts, images, graphics, design, logos, program code, databases) are objects of intellectual property of the Service Provider and are protected by the legislation of the Republic of Kazakhstan.

9.2. Use of Website materials without written permission from the Service Provider is prohibited.

9.3. The User may use Website materials exclusively for personal non-commercial purposes.

9.4. Medical data uploaded by the User remains their property. The Service Provider uses it only to provide Services.

10.1. The Service Provider undertakes to maintain confidentiality of personal and medical data of Users in accordance with the Privacy Policy posted at:https://genelab.kz/en/privacy-policy

10.2. Medical data is transferred only to geneticists for providing consultations. All physicians sign a medical confidentiality agreement.

10.3. The Service Provider does not sell or transfer personal data to third parties, except in cases provided by the legislation of the Republic of Kazakhstan.

11.1. All disputes and disagreements arising from this Agreement are resolved through negotiations.

11.2. If it is impossible to settle the dispute through negotiations, the User sends a written claim to the Service Provider to the email address: r.nazarbekova@qazgene.kz

11.3. The Service Provider must review the claim within 10 business days from receipt and send a reasoned response.

11.4. If it is impossible to resolve the dispute through claims procedure, the dispute is referred to court at the location of the Service Provider in accordance with the legislation of the Republic of Kazakhstan.

12.1. The Parties are released from liability for partial or complete failure to fulfill obligations under this Agreement if this failure was a result of force majeure circumstances.

12.2. Force majeure circumstances include: natural disasters, military actions, terrorist attacks, epidemics, strikes, government bans, internet provider failures, hacker attacks, and other events beyond the Parties' control.

13.1. This Agreement comes into force from the moment of User's acceptance of the offer and is valid indefinitely until the User deletes their account or the Service Provider terminates the Agreement.

13.2. The User may terminate the Agreement unilaterally by deleting their account.

13.3. The Service Provider may terminate the Agreement unilaterally in case of User violation of these Terms.

13.4. All appendices and additions to this Agreement are its integral part.

13.5. If any provision of this Agreement is declared invalid, this does not entail invalidity of the remaining provisions.
